// terms_

these terms apply when you use this site or buy a tune file from tunedaddy. support: support@tunedaddy.com.au.

// the service_

we provide a software service: you upload the stock .map file you read from your own td5 ecu with a nanocom evolution, we check it is compatible, apply our validated tune overlay to your file, recompute the nanocom checksum, and deliver the modified .map for you to download and flash yourself. we supply a digital file only — we do not perform any physical work on your vehicle and we do not build bespoke tunes.

// what you must do_

only upload a map read from a vehicle you own or are authorised to modify. before flashing: save your injector codes and keep an unmodified backup of your original map; use a good-quality sd card; connect a suitable stable power supply; keep the ignition at stage 2 with the engine off; switch off other electrical equipment; and follow the current official nanocom instructions. do not disconnect, move or operate the nanocom, switch the ignition unexpectedly, or interrupt power while the ecu is being written. you need a working nanocom evolution and a mechanically healthy vehicle — worn injectors, boost leaks, cooling problems, sensor faults and other existing conditions can affect results or cause damage.

// risk_

modifying and writing an ecu carries real risk. the write process erases and rewrites ecu memory; interruption, unstable voltage, connection failure, faulty equipment, incorrect operation or another write failure can corrupt the ecu and leave it — and the vehicle — unusable until the ecu is recovered or replaced. altered engine management can increase load on the engine, turbocharger, transmission, cooling and fuel systems, and can expose or worsen existing faults. our compatibility check validates the uploaded file against our supported calibration data; it is not an inspection of the vehicle, nanocom, battery, wiring or mechanical condition. checksum validation, stock backups and installation steps reduce risk but cannot eliminate it.

you decide whether to modify and operate the vehicle and you perform or arrange the ecu write. subject to the australian consumer law provisions below, you accept responsibility for that decision, the flashing process, the condition and suitability of the vehicle and equipment, and the consequences of failing to follow the instructions.

// road use and compliance_

we produce and supply tune files solely for off-road, motorsport and closed-course use where lawful. they are not produced, tested, approved or certified for use on public roads, and we make no representation that a modified vehicle will comply with emissions, registration, roadworthiness, modification-certification or insurance requirements.

do not install or use a tune file on a vehicle used on a public road or road-related area unless you have independently confirmed that the modification and vehicle comply with every law, standard, approval and certification requirement that applies in your state or territory. you are responsible for lawful use, any required inspection, testing or certification, and notifying your insurer or other interested parties.

// performance_

the mild tune is a conservative, engine-tested calibration. results vary with vehicle condition, so we do not promise a specific power, torque, economy, towing or reliability outcome.

// your licence to the file_

the tune file we deliver is licensed for use on the single vehicle whose map you uploaded. you may keep private backups. you must not resell or redistribute the file, or extract our overlay for use on other vehicles or in other products.

// australian consumer law_

our services come with guarantees that cannot be excluded under the australian consumer law, including that they are provided with due care and skill and are fit for any purpose we have agreed to supply them for. nothing in these terms excludes, restricts or modifies those guarantees, your right to compensation for reasonably foreseeable loss caused by our failure to comply with them, or any other right or liability that cannot lawfully be excluded. the refunds page explains how we handle problems.

// liability_

to the maximum extent permitted by law, and without limiting the australian consumer law provisions above, tunedaddy is not responsible for ecu, engine, turbocharger, transmission, driveline or other vehicle damage, an unusable vehicle, recovery or repair costs, loss of use, or other loss to the extent it is caused by: your decision to modify, flash or operate the vehicle; interruption, unstable voltage, connection failure, radio-frequency interference or incorrect ignition sequencing during a read or write; the nanocom, sd card, battery, power supply, wiring or other third-party equipment; an existing vehicle fault or unsuitable vehicle condition; using an incorrect, corrupted, altered, redistributed or third-party file; changing our delivered file; failing to keep the original map or injector codes; failing to follow our or the nanocom manufacturer's current instructions; use outside the supported vehicle and calibration; or unlawful or public-road use.

this limitation does not apply to the extent the loss is caused by our failure to comply with a non-excludable consumer guarantee or by another act or omission for which liability cannot lawfully be excluded. where the law permits liability to be limited, our liability is limited only to the extent the law permits.
